CogNeed Acceptable Use Policies

Short version: When using the Service, you must comply with our Acceptable Use Policies, which include certain restrictions on the Content you can post, your conduct on the Service, and other limitations. Terms in capital letters used but not defined in these Acceptable Use Policies have the meaning given to them in our Terms of Service. "You" and "your" refer to the "Client" or "Users," and "We," "we," "our" refer to "CogNeed."

I. Compliance with Laws and Regulations

You are responsible for using the Service in compliance with all applicable laws, regulations, and all of our Acceptable Use Policies. These policies may be updated from time to time and are provided below, as well as in our Terms of Service.

II. Content Restrictions

Under no circumstances shall Users upload, post, host, perform, or transmit any Content that:

• Is illegal or promotes illegal activities;
• Is or contains sexually obscene content;
• Is libelous, defamatory, or fraudulent;
• Is discriminatory or abusive towards an individual or group;
• Depicts or gratuitously glorifies violence, including violent images;
• Is or contains false, inaccurate, or intentionally misleading information that could harm the public interest (including health, safety, election integrity, and civic participation);
• Directly supports illegal active attacks or malware campaigns that cause technical harm - such as using our platform to deliver malicious executables or as attack infrastructure, for example by organizing denial-of-service attacks or managing command and control servers, without dual-use notification before the abuse occurs; or
• Shares unauthorized product license keys, software to generate unauthorized product license keys, or software to bypass product license key verifications, including extending a free license beyond its trial period; or
• Violates any proprietary right of any party, including patent, trademark, trade secret, copyright, right to publicity, or any other right.

III. Conduct Restrictions

When using the Service, you shall not under any circumstances:

• Harass, abuse, threaten, or incite violence towards any individual or group, including our employees, officers, and agents, or other users;
• Post off-topic content or interact with the platform's features in a manner that significantly or repeatedly disrupts other users' experience;
• Use our servers for any form of excessive automated mass activity (e.g., spamming or cryptocurrency mining), impose an undue load on our servers through automated means, or relay any form of unsolicited advertising or solicitation through our servers;
• Use our servers to disrupt or attempt to disrupt, or to gain or attempt to gain unauthorized access to any service, device, data, account, or network;
• Impersonate any person or entity, including any of our employees or representatives, including by falsely associating yourself with CogNeed, or by fraudulently misrepresenting your identity or the site's purpose; or
• Violate the privacy of a third party, for example, by posting another person's personal information without their consent.
  

IV. Spam and Inauthentic Activity on CogNeed

Excessive automated mass activities and coordinated inauthentic activities, such as spam, are prohibited on CogNeed.

Prohibited activities include:

• Mass distribution of promotions and advertisements prohibited by CogNeed's terms and policies
• Inauthentic interactions, such as fake accounts and automated inauthentic activities
• Using CogNeed as a platform to propagate abuse on other platforms
• Phishing or attempting to phish
  

V. Services Usage Limits

You will not reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, use of the Service, or access to the Service without our express written permission.

VI. Information Usage Restrictions

You may use the information from our Service for the following reasons, whether the information has been extracted, collected through our API, or obtained otherwise:

• Researchers may use public and non-personal information from the Service for research purposes, only if the resulting publications are freely accessible.
• Archivists may use public information from the Service for archiving purposes.

Scraping refers to the extraction of information from our Service through an automated process, such as a bot or web-crawler. Scraping does not refer to the collection of information via our API. Please see our Terms of Service for our API usage terms.

You may not use information from the Service (whether retrieved, collected through our API, or otherwise obtained) for spam purposes, including for the purpose of sending unsolicited emails to users or selling users' personal information (as defined in our Privacy Policy), especially to recruiters, headhunters, and job sites.

Your use of information from the Service must be in compliance with our Privacy Policy.

VII. Privacy

Misuse of user personal information is prohibited.

Anyone, entity, or service collecting data from the Service must comply with the Privacy Policy, especially regarding the collection of User Personal Information. If you collect personal information from users through the service, you agree to use that personal information only for the purposes for which the user has authorized it. You agree to reasonably secure all user personal information that you have collected from the service, and you will respond promptly to complaints, deletion requests, and "do not contact" requests from us or other users.

VIII. Excessive Bandwidth Use

The bandwidth limits of the Service vary depending on the features you use. If we determine that your bandwidth usage is significantly excessive in comparison to other users with similar functionalities, we reserve the right to suspend your account, limit your file hosting, or restrict your activity until you can reduce your bandwidth consumption.

IX. Advertising on CogNeed

Short version: We generally do not prohibit the use of CogNeed for advertising purposes. However, we expect our users to respect certain limits, so that CogNeed does not become a haven for spam. Nobody wants that.

You may include static images, links, and promotional text in Your Content, but they must be related to the project you are hosting on CogNeed. You cannot advertise in other users' accounts, for example by posting monetized or excessive bulk content.

You cannot promote or distribute content or activities that are illegal or otherwise prohibited by our Terms of Service or our Acceptable Use Policy, including excessive automated mass activities (e.g., spam) and false representations or deceits related to your promotion.

If you decide to publish promotional information on your account, you are solely responsible for complying with all applicable laws and regulations. We reserve the right to remove any promotional information or advertising that, in our sole discretion, violates CogNeed's terms or policies.

CogNeed reserves the right to remove any Content in violation of this policy.

X. User Protection

You must not engage in any activity that significantly harms other users. We will resolve disputes in favor of protecting Users as a whole.
